FASHION HOUSE CLUB LOYALTY PROGRAM RULES

(as amended on April 2, 2020)

1. GENERAL PROVISIONS

1.1. These Rules define the procedure, conditions, location, and terms of the FASHION HOUSE CLUB Loyalty Program using electronic loyalty cards (hereinafter referred to as the Program).
1.2. These Rules constitute a public offer in accordance with Article 437 of the Civil Code of the Russian Federation and are accepted by all Program participants in full and unconditionally upon registration.
1.3. The Program Organizer (hereinafter referred to as the Organizer) is a branch of the limited liability company "FH HOLDING MOSCOW LIMITED" (TIN 9909312300, Accreditation Record Number 10150005382, located in: Russian Federation, 141580, Moscow Region, Solnechnogorsk Municipal District, Lunevskoye rural settlement, in the area of ​​the village of Chernaya Gryaz, ul. Torgovo-Promyshlennaya, building No. 6 B, room No. 88).
The Organizer determines the basic terms of the Program, has the rights to organize and develop it, amend the terms of the Program, and determines the purposes of processing the personal data of Program Participants, the composition of such data subject to processing, actions (operations) performed with personal data and, independently or with the involvement of third parties, organizes and (or) carries out the processing of personal data. Program Participants.
1.4. The Program is implemented by the Organizer in the Russian Federation in accordance with these Rules.
1.5. Joining (registering) and participating in the Program constitutes the Participant's confirmation of having read and agreed to all provisions of these Rules. The current version of the FASHION HOUSE CLUB Program Rules is posted on the website www.fashionhouseoutlet.com (hereinafter referred to as the Website) and is accessible at https://www.fashionhouseoutlet.com/club/.
1.6. The Organizer reserves the right to unilaterally modify, suspend, or terminate the Program at any time, at its sole discretion, or to modify the Program Rules by posting the updated Rules on the Website without any special notice to Participants.

2. TERMS AND DEFINITIONS

For the purposes of these Program Rules, the following terms and definitions are used (regardless of whether the term is capitalized or lowercase):
FASHION HOUSE CLUB Loyalty Program or the Program – a loyalty rewards program for Program Participants that allows access to the privileges defined by the Organizer, as specified in paragraph 3.5 of these Rules.
Program Rules or Rules – this document defining the terms and conditions for Participants' participation in the Program, available in the current version for review by any interested party on the Website.
Website – the Organizer's website on the Internet, accessible to any Internet user at www.fashionhouseoutlet.com, through which Program Participants are informed about the Rules Program, Program partner stores, and other information about the Program.
Program Participant – a legally competent individual registered and permanently residing in the Russian Federation, who has registered for the Program on the Website in accordance with these Rules and complies with the Program terms. By participating in the Program, the Participant confirms that they have fully read and unconditionally agree to all Program terms and conditions, as well as these Rules.
Electronic Loyalty Card or "FASHION HOUSE CLUB" Loyalty Card – a special card for Program Participants, provided by the Organizer to the Program Participant in electronic digital format, allowing the Participant to receive discounts in accordance with the Program terms when paying for goods at partner stores within the FASHION HOUSE Outlet Center.
The terms and definitions used in these Rules apply exclusively to this Program.

3. TERMS OF PARTICIPATION IN THE PROGRAM

3.1. To register for the program, Participants must complete the following steps:
1) Using any Android or iOS mobile device, visit the dedicated Program page on the Website at https://www.fashionhouseoutlet.com/club/,
2) Enter their phone number in the designated field and click "NEXT,"
3) Complete the registration form, indicating their first name, last name, date of birth, and email address,
4) Read the Program Rules and the Organizer's Privacy and Personal Data Processing Policy and confirm their acceptance by checking the appropriate box on the registration form,
5) Send the registration form to the Organizer by clicking "GET A CARD." By clicking the "GET CARD" button in the registration form, the Participant confirms that they have read and unconditionally agree to the Program terms, these Rules, and the Organizer's Privacy and Personal Data Processing Policy posted on the Website, and also consents to the processing of their personal data specified in the registration form.
3.2. After successfully registering for the Program, the Participant is redirected to a separate page on the Website to download the FASHION HOUSE CLUB Loyalty Card to their mobile device. Once downloaded, the FASHION HOUSE CLUB Loyalty Card will be displayed on the Participant's mobile device in the Google Pay or Apple Wallet app, respectively (depending on the respective mobile device platform). The Organizer also reserves the right to additionally send the Participant an SMS message to the mobile phone number and/or an email to the email address specified by the Participant upon registration for the Program on the Website, or a push notification containing a link to download the "FASHION HOUSE CLUB" Loyalty Card to the Participant's mobile device.
3.3. The Participant is solely responsible for the accuracy, currency, completeness, and compliance with Russian Federation law of all information and data provided to the Organizer upon registration for the Program. The Organizer reserves the right to verify the data and information provided by the Participant using legal methods and legitimate external services. When registering for the Program, the Participant is required to provide accurate information, including an email address and mobile phone number registered directly to the Participant. If inaccurate data is discovered, or if any claims are made against the Organizer by third parties or government agencies due to the Participant providing inaccurate data upon registration, including If the Participant's phone numbers and email addresses are registered to another individual or legal entity, the Participant is obligated to resolve such claims independently and at their own expense and fully compensate the Organizer for all damages caused by such claims. Furthermore, the Organizer reserves the right to delete the Participant's registration account and the data they have entered, as well as block the FASHION HOUSE CLUB Loyalty Card issued by the Organizer for such Participant.
3.4. After registering in the Program, the Participant becomes a Program Participant and can use the FASHION HOUSE CLUB Loyalty Card (upon receipt) to receive discounts on goods at participating stores within the FASHION HOUSE Outlet Center, as well as enjoy other privileges provided by the Organizer to Program Participants.
3.5. The list of privileges for Program Participants, their validity period and terms of provision are determined by the Organizer independently. The Organizer provides the following privileges to Program Participants:
– the opportunity to receive additional discounts of 5% to 10% on purchases at participating stores within the FASHION HOUSE Outlet Center and receive special offers on select brands;
– the opportunity to participate in "Closed Sales" organized by partner stores and/or the Organizer within the FASHION HOUSE Outlet Center in advance of Seasonal Sales;
– the opportunity to receive electronic invitations to "Client Days";
– the opportunity to receive electronic invitations to special events and new store openings within the FASHION HOUSE Outlet Center;
– the opportunity to receive electronic newsletters about the latest news, events, and special promotions within the Program.
The Organizer may also provide other privileges for Program Participants. A complete and current list of privileges for Program Participants is published by the Organizer on a dedicated page of the Website https://www.fashionhouseoutlet.com/club/.
3.6. It is prohibited to use the privileges provided under the Program and the FASHION HOUSE CLUB Loyalty Card for commercial purposes and/or for the benefit of other persons engaged in entrepreneurial activity.
3.7. In the event of non-compliance with the Program Rules, the Organizer reserves the right to block or cancel the FASHION HOUSE CLUB Loyalty Card of the relevant Participant, as well as apply other restrictions to participation in the Program to any Participant, including excluding the Participant from the Program, without warning, including in cases of abuse of the rights granted to the Participant under the Program or suspicion of fraudulent or other illegal actions within the Program.
3.8. A Participant has the right to terminate their participation in the Program at any time, as well as revoke their consent to the processing of their personal data by sending a written notice to the Organizer at the address specified in paragraph 1 of these Rules. In either case, such person automatically ceases to be a Participant in the Program.
3.9. If a Participant is excluded from the Program by the Organizer's decision or if the Participant terminates their participation in the Program, the Participant's "FASHION HOUSE CLUB" Loyalty Card will be cancelled, and additional privileges will not be provided without compensation.

4. FINAL PROVISIONS

4.1. The Organizer is not responsible for any consequences of Participant's errors related to participation in the Program, including any costs incurred, and will not reimburse or compensate for any possible losses or expenses.
4.2. The Organizer is not responsible for technical failures in the Program, the Website, or telecom operators.
4.3. The Organizer is not responsible if the Participant is unable to take advantage of all or some of the privileges available to Program Participants or discounts with the FASHION HOUSE CLUB Loyalty Card during the Program period.
4.4. The Organizer is not responsible for the operation of participating stores in the Program, or the range, quality, or availability of goods in such stores. All claims in such cases must be submitted directly to the participating stores.
4.5. These Rules are the sole document governing the relationship between the Organizer and the Participant. In the event of situations that allow for ambiguous interpretation of these Rules and/or issues not regulated by these Rules, the final decision on such interpretation and/or clarification is made directly and exclusively by the Organizer.
4.6. The Program has no time limit. In the event of termination of the Program, the Organizer will notify Program Participants by publishing a notice of termination on the Website.
4.7. In all matters not provided for in these Rules, the Organizer and Participant are guided by the current legislation of the Russian Federation.
